These Terms govern your use of deutschmark toolset ("Toolset"). By signing in with Twitch or otherwise using the Toolset features, you agree to these Terms. If you do not agree, do not use Toolset.

Toolset is operated globally for Twitch creators. Infrastructure is hosted on Cloudflare in the United States — see the Privacy Policy for data flows, retention, and your rights.

1. Acceptance and Eligibility

By accessing or using Toolset, you confirm that:

  • • You are at least 13 years old (Twitch's age floor) and have the legal capacity to agree to these Terms in your jurisdiction. If you are between 13 and the age of majority where you live, you confirm a parent or legal guardian has consented.
  • • You hold a valid Twitch account in good standing and your use complies with the Twitch Terms of Service and Community Guidelines.
  • • You are not on a sanctions list or otherwise prohibited from using US-based services.

2. Description of Service

Toolset is a creator utility for Twitch streamers. Core features include hosted OBS and browser sources, music widgets backed by your own Spotify Developer App, chat tools, clip and video helpers, an optional local ForgetMeNot chat bot runtime, and setup pages for related downloads.

Toolset is provided as a free, community-funded service. There is no service-level agreement (SLA) and no guaranteed uptime. Features ship, change, and occasionally retire as the product evolves.

3. Account and Twitch Login

Your Toolset account is bound to your Twitch login. Sign-in goes through Twitch OAuth and the resulting session cookie scoped to .deutschmark.online identifies you across Toolset surfaces.

If your Twitch account is suspended, banned, or deleted, your Toolset access tied to that account ends with it. Toolset may suspend or terminate access at any time for violations of these Terms, abuse, or to protect the service or other users.

You are responsible for keeping your Twitch credentials and any device sessions secure. Notify the contact address below if you suspect unauthorized access.

4. Acceptable Use

You agree not to use Toolset to:

  • • Operate a harassment bot, spam bot, or any automated tool that violates Twitch's automated tooling, anti-spam, or harassment policies.
  • • Send mass unsolicited messages, raid notifications, or other content that violates the Twitch Terms of Service.
  • • Evade a Twitch suspension or ban, whether yours or someone else's.
  • • Use third-party services through Toolset to push content that infringes copyright or other intellectual property rights. Toolset stores only the URL you provide; the underlying media is hosted by Twitch, YouTube, Spotify, or whichever platform owns it. Their copyright processes (and their DMCA agents) apply to the actual content.
  • • Scrape, crawl, or extract data from Toolset, its workers, or its hosted sources beyond the documented APIs and your own account's data.
  • • Interfere with the operation of the service: probing for vulnerabilities (other than coordinated, good-faith disclosure to the contact address), denial-of-service attempts, rate-limit evasion, token forgery.
  • • Reverse-engineer paid mechanics or attempt to bypass Stripe-backed donation flows to obtain supporter perks without contributing.
  • • Use Toolset for illegal activity in your jurisdiction or in the United States.

5. Your Content and License

You own the configurations, source labels, command profiles, playlists, donation messages, and other content you create or push through Toolset ("Your Content").

By using Toolset, you grant Toolset a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely as needed to operate the service for you — for example, serving a hosted OBS source you created, displaying your handle on the public monthly funder list (unless you opt out at checkout), or relaying chat replies generated by your local ForgetMeNot runtime.

You are responsible for Your Content, including the clips and videos you push to stream, the songs you queue, the messages your bot account sends, and the AI-generated replies your local ForgetMeNot runtime produces. Toolset does not pre-screen Your Content.

6. Third-Party Services Pass-Through

Toolset connects to third-party services on your behalf, including but not limited to Twitch, Spotify, Discord, Stripe, and Google Gemini. When you use a feature that touches a third-party service, that service's own terms and policies also apply to your use, including:

If you violate a third-party service's terms while using Toolset, Toolset may suspend or restrict your access to the affected feature in addition to any action the third-party service takes.

7. Chat Bot Responsibility

ForgetMeNot is the optional Toolset chat bot runtime that runs on your local machine. When you connect ForgetMeNot to your Twitch channel through a bot account, you are responsible for:

  • • Compliance with Twitch's automated tooling, anti-spam, and harassment policies.
  • • The behavior of the bot in your channel — including its responses to viewers, moderation outputs, and AI-generated content produced via your Google Gemini API key.
  • • Disclosing AI-generated content where required by law or platform policy in your jurisdiction.
  • • Keeping your Gemini API key secure (it lives on your local machine — see the Privacy Policy).
  • • Any chat-message processing performed by ForgetMeNot, since you are the controller of that processing in your channel.

Toolset is not liable for the content ForgetMeNot generates or for actions it takes under your direction. If a viewer is harmed by bot behavior in your channel, the streamer-controller is the responsible party.

8. Open Source and Self-Hosted Components

Some Toolset components are open source or run locally:

  • • A read-only public mirror of the toolset frontend is published at github.com/thedeutschmark/toolset for transparency. License terms in that repository govern use of the source.
  • • ForgetMeNot ships as a local runtime you install and operate yourself; its license terms accompany the download.

These Terms govern your use of the hosted Toolset service. The licenses on each open-source component govern your use of that component's source code.

9. Donations and Supporter Perks

Toolset accepts voluntary donations through Stripe and offers a recurring monthly supporter tier. Donations are not fees for service — Toolset is free, and donations fund operating costs.

Cosmetic perks (Silver Kappa theme at $5 lifetime, Golden Kappa theme at $20 lifetime, community funder badge) are recognition tokens for cumulative contribution. Active-supporter functional perks (bonus source slots, Discord supporter role, early access to new tools) require an active Stripe subscription and end when the subscription lapses.

Donations are generally non-refundable. If you believe a charge was made in error, email the contact address below within 30 days; refunds are evaluated case-by-case. Card management, plan changes, and cancellation are handled through the Stripe Customer Portal linked under Settings → Billing.

10. Disclaimers

Toolset is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted service.

Toolset depends on third-party services (Twitch, Spotify, Stripe, Discord, Cloudflare, Google) for substantial portions of its functionality. Toolset does not warrant the continuous availability of those services or that integrations with them will remain stable as those services evolve. Some jurisdictions do not allow the exclusion of certain warranties; the exclusions in this section apply to the maximum extent permitted by applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Toolset and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use Toolset.

Total aggregate liability for any claim arising out of or related to these Terms or the service is limited to the greater of (a) the amount you paid Toolset in the twelve months preceding the claim, or (b) USD $50. Donations made for community funding purposes are not fees for service and do not raise this cap.

Some jurisdictions do not allow limitations on certain damages; in those jurisdictions, liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to indemnify and hold Toolset and its operator harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of:

  • • Your use of Toolset in violation of these Terms or applicable law.
  • • Your violation of a third-party service's terms while using Toolset (e.g., Twitch ToS, Spotify Developer Policy).
  • • Intellectual-property claims arising from URLs you configured Toolset to display through your stream — the underlying media is hosted by the third-party service whose URL you used.
  • • Harm caused by your bot in your channel, including harassment, spam, or moderation actions performed by ForgetMeNot under your direction.
  • • Unauthorized access to your Toolset account through credentials you failed to keep secure.

13. Termination

You may terminate your use of Toolset at any time by signing out, disconnecting third-party services from the Connections page, deleting hosted source tokens, and emailing the contact address below to request account deletion (see the Privacy Policy for what gets removed).

Toolset may suspend or terminate your access at any time for violations of these Terms, for abuse of the service, when required to comply with Twitch enforcement actions or applicable law, or to protect Toolset or other users. Where reasonable, you will be given notice and an opportunity to cure.

Sections that by their nature should survive termination — including Your Content license to the extent needed to provide service to you up to termination, disclaimers, limitation of liability, indemnification, and dispute resolution — survive.

14. Modifications to the Service

Toolset is an actively-developed product. Features may be added, changed, deprecated, or removed over time. Significant changes are surfaced through the What's-new feed in the topbar and the /changes page.

These Terms may be updated to reflect changes to the service, the law, or operational practices. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted on the What's-new feed. Continued use of Toolset after a Terms update means the updated Terms apply to your use of the service.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or related to these Terms or your use of Toolset will be resolved in the state or federal courts located in New York County, New York, and you consent to the exclusive jurisdiction and venue of those courts. This does not deprive you of any consumer protections that apply in your country of residence and that cannot be waived by contract.

16. Miscellaneous

16.1 Severability

If any provision of these Terms is held unenforceable, that provision will be modified only to the minimum extent necessary, and the remaining provisions remain in full force.

16.2 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Toolset regarding the service and supersede any prior agreements on the same subject.

16.3 No waiver

Failure to enforce any provision is not a waiver of the right to enforce it later.

16.4 Assignment

You may not assign these Terms without prior written consent. Toolset may assign these Terms in connection with a merger, acquisition, or sale of substantially all assets, with reasonable notice to you.
